Employee verses member/partner

Question:

In order to avoid hiring someone as an employee, can a LLC organized as a partnership, give an employee a 10% stake in the company, making them a partner/member, verses an employee? Would access cash distributions be handled as Guaranteed payments? What entrys would be recorded for the access distributions?

Any help would be greatly appreciated.

Check with an attorney -- from an accounting and payroll perspective there are no problems with what you're suggesting.
