 Post subject: Payroll taxes?

Hello all,

I could use some help on a payroll taxes question. I know little to nothing about payroll taxes, so let's begin! I work in Minnesota and the company I work for is bases in North Carolina, very small company...I'm the only employee, besides the owner. So, to verify, I will have to pay Minnesota Income tax on my paychecks...not North Carolina Income tax...Correct?

Point me in the right direction if I'm way off here : )

You are correct. You are taxed where you earn it and you earned it in Minnesota.

Okay, but the company doesn't have an office in MN, I work out of my home. I assume this doesn't matter...?

You need to read this case:

Panos v. Timco Engine Center, Inc., __ N.C. App. __, 677 S.E.2d 868 (2009)

You might be in a pickle if you ever want to file unemployment.

As to withholding taxes, it appears that NC Withholding should only be withheld on income actually earned in NC while performing services there. Your tax home is MN even though you probably report to NC headquarters regularly.

To be on safe side, suggest you call NC Department of Revenue.

And for the company I work for to withhold and pay MN state income taxes they need to have a Minnesota State Tax ID#...correct?

Hi,
Yes, you need to pay there where your office is located or company is registered.

You need to pay on that location where company has been registered.
